1. Copyright
With Love Fine Wedding Stationery owns the copyright and all intellectual property rights in and to the materials it creates and commercialises. Ownership of such materials vests in With Love Fine Wedding Stationery pursuant to the Copyright Act 1968 (Cth). The Copyright Act provides for serious penalties for breaches of intellectual property laws, in addition to common law damages claims available to the party whose intellectual property rights are infringed. You are prohibited from copying, reproducing, altering, modifying, creating derivative works, or publicly displaying any of the materials created by With Love Fine Wedding Stationery, other than for the purpose the materials were purchased pursuant to this Agreement.

2. Sample Ordering & Permission for Sample Display
(a) Before you place an order, we strongly recommend purchasing a sample pack. The full price of the sample pack of the collection you proceed to order is redeemable. Samples are available to order in our two standard colours in all designs. A sample pack will include four pieces of stationery in a mix of our standard colour palettes. This gives you the opportunity to view our standard colour options and get a feel for the paper stock. Unfortunately due to the nature of our printing process, we cannot supply samples in custom colours. A colour chart is supplied with each sample order which will allow you to see the colours available to print should one of our two standard colour palettes not be suitable. It is possible that a subtle variation can occur between your sample and your final prints - see clause 9 for further information.

(b) From time to time we may be asked to submit samples of our work to potential clients, media and magazines and for trade shows and events. We also use samples of our work on our website and our blog. With Love Fine Wedding Stationery will not use samples of your stationery for these purposes if you have requested us not to.

3. Ordering & Payment
Each order is printed on an as-needs basis and therefore full payment is required before the ordering process will begin. We can accept credit card payments through PayPal or by bank deposit, cheque or money order. Please select your preferred option at the time of ordering and With Love will provide the necessary details required for you to make payment. Payment will need to be cleared before work can commence. Once work has commenced on your order there can be no refunds - see clause 12 for further information on cancellations and refunds.

4. Minimum Order
Our minimum order quantity is 50 per stationery piece, excluding menus (if you wish to order per table, rather than per guest) and other one-off pieces you may require such as table seating charts, table numbers etc. We strongly advise that you order spares of all stationery in most instances as orders that need to be reproduced may incur the minimum quantity of 50 charge at the discretion of With Love Fine Wedding Stationery. If you wish to order less than the minimum quantity, please contact us.

5. Pricing
All prices supplied to you are in Australian dollars (AUD). These prices do not include GST. At this time, With Love Fine Wedding Stationery is not registered for GST and therefore does not charge GST. Prices are subject to change and With Love Fine Wedding Stationery reserves the right to alter the price of any product or service without notification. With Love Fine Wedding Stationery will collect information pertaining to additional services required via our order form.

6. Inclusions
Unless you request otherwise, envelopes are included in the price of save the date cards, invitations, thank you cards and rsvp cards, and are matched to the design you have chosen. If our suppliers are out of stock of the envelopes required for your order, we will contact you to arrange an alternative. Unfortunately we are unable to offer the service of printing addresses on envelopes at this time. Our save the date cards include a magnet affixed to the reverse side. Please advise upon ordering if you wish to omit any of these items or services from your order. Unfortunately we cannot discount if you choose to remove an included item or service.

7. Personalisation
(a) If you require your guest names printed on your invitations, placecards etc. you will need to advise us when you order. We strongly advise that you do not put our stationery through another printer to include the names of your guests, so please bear this in mind when placing your order.

(b) It is possible to leave a space on our invitations for you to have the guest names written in i.e. you may be using a calligrapher. Again, please select this option when you order. It is strongly recommended that you test the pen that you will be using to write on the stationery to avoid smudging and consequently, reprinting. We also suggest ordering an extra 5-15 pieces in case of errors made by the calligrapher.

(c) If you have opted to personalise your stationery with guest names, please supply us with your guest list in a Microsoft Excel file with the names typed exactly how you would like to see them spelt and written i.e. Mrs and Mrs Brown, Katrina and Robert Brown or Katrina and Robert. Please list these names one line per cell. A template can be provided to you if you are unsure. It is important that you check your details thoroughly before providing your list, as the guest names will be printed exactly how they are supplied to us. The accuracy of all spelling, punctuation and spacing is your responsibility. These can be re-checked at proofing stage, however any errors supplied by you after printing has begun are at your responsibility and if reprinting is necessary, will be at the your cost.

8. Semi-DIY
Selected designs within With Love Fine Wedding Stationery’s collection are semi-diy. This means that With Love Fine Wedding Stationery will provide you with the printed stationery and the necessary embellishments (i.e. ribbon, pearls etc.) and instructions to ensure that you can complete the designs as per the example photographs and illustrations on our website. If you require additional embellishments due to error of your own, you will be responsible for the cost of replacements. As noted in clauses 4 and 7, With Love Fine Wedding Stationery strongly advise that you order 5-15 extra pieces to cover for personalisation or assembly errors.

9. Wording Suggestions
Wording suggestions for your stationery pieces are available within the ‘inspire me’ section of our website. You can provide your own wording to With Love Fine Wedding Stationery if you wish, however, if it has been taken from another website that has copyright in that wording then With Love Fine Wedding Stationery will not be responsible for copyright infringement or breach of confidence.

10. Warranties and Indemnity
You hereby make the following warranties and representations to With Love Fine Wedding Stationery in respect of any literary, design or other materials (the “Materials”) you deliver to With Love Fine Wedding Stationery:

(a) The Materials shall be your original work, or appropriately sub-licensed, by you, and will not constitute any infringement of any copyright, trade mark, design right, or other proprietary right or interest or any statutory right or other rights whatsoever of any third party;

(b) The Materials will not be is abusive, defamatory, discriminatory, hateful, obscene, vulgar, sexually-orientated, threatening, or otherwise objectionable; and

(c) To the best of the your knowledge no part of any of the Material is defamatory and does not constitute breach of privacy, breach of censorship laws, or breach of any other law, by-law, regulation or any other statutory or common law, right, interest or entitlement and does not contain any matter constituting a breach of confidence.

You hereby fully indemnify With Love Fine Wedding Stationery against all claims of liability and costs and expenses (including legal fees, costs and disbursements on the higher of a full indemnity basis and a solicitor and own client basis, determined without taxation, assessment or similar process and whether incurred by or awarded against With Love Fine Wedding Stationery) which With Love Fine Wedding Stationery may incur as a result of any breach of these warranties by you or any actual or threatened claim by a third party arising in any way whatsoever from the use, publication or printing of the wording you supply to With Love Fine Wedding Stationery pursuant to this Agreement.

With Love Fine Wedding Stationery reserves the right to decline to use, publish or reproduce any image supplied by you for any reason, including but not limited to insufficient evidence provided of ownership or licence, or that such image may result in a breach of clause 10(a) or 10(b).

11. Proofing
(a) Before printing commences, a PDF proof will be emailed to you for final sign off of the artwork. It is your responsibility to check that all information and details are correct. Once you have checked your proof and you have no further changes, you will need to notify us in writing (via email is acceptable) that you are happy to proceed with the order. If there are changes to be made they need to be acknowledged and amended at this point. Please ensure that the text you provide us is as close to final as possible as we can only honour two rounds of changes during the proofing stage. If further rounds of changes are required at no fault of With Love Fine Wedding Stationery, there will be an amendment charge involved at the discretion of With Love Fine Wedding Stationery.

(b) If you have ordered a design in custom colour, we can supply a printed proof at your request however this will incur an additional charge. Please select this option on our order form. It is important to note that there may be a slight variance in colour of your printed proof and your final prints - see clause 12 below.

(c) Once we have received your approval of the proof, the printing process will begin and your order will be posted to the address you have elected on our order form, or be available for collection. Please allow at least 10 working days from approval of your proof to delivery.

12. Digital Printing and Colour Variances
Our stationery pieces are printed digitally and it is possible that subtle variances in colour can occur between print runs. This is a natural effect of the digital printing process that cannot be avoided. Stationery cannot be refunded or returned because of colour variances. With Love Fine Wedding Stationery products are of the highest quality and we can assure that you that our stationery is printed to the highest professional printing standards.

13. Images
(a) Images that are to be used in your stationery pieces can be supplied to us on disc or via email. Unfortunately at this time, we cannot accept hard copies. With Love Fine Wedding Stationery is not responsible for any discs lost in the mail so if you are concerned, please keep an original copy of the disc for yourself. Please ensure digital photographs have been taken at the highest megapixel setting and size on your camera. With Love Fine Wedding Stationery will check your photos upon receipt to ensure they are at suitable quality for printing. With Love Fine Wedding Stationery reserve the right to refuse images that are not of high quality suitable for printing, or are offensive material.

(b) With Love Fine Wedding Stationery will not be liable for variations in colour or quality of your photographs as compared to other printed versions, or flaws in the image that you have provided to us. Please be aware that printed images on your stationery may differ in colour, quality and lightness/darkness as compared to what appears on screen or printed photographs as a different printing process and technique is used.

14. Postage & Delivery
(a) Postage is calculated upon order. Each order will be delivered by Australia Post via registered mail or courier and a signature will be required. We are not liable for any damage whatsoever caused in transit as we ensure your order is packed to the highest standard so it will reach you in the condition it left us. Sample packs are sent via regular post and do not require a signature.

(b) As a guideline, please allow up to four weeks from start to finish of your order. To ensure With Love Fine Wedding Stationery can meet your deadline, please arrange payment and supply information pertaining to your order as soon as possible. You should also be available to approve your proofs as quickly as possible. With Love Fine Wedding Stationery reserves the right to turn away orders where deadlines cannot be met.

(c) With Love Fine Wedding Stationery will not be liable for any failure or delay in delivery of any ordered materials or services if that failure or delay arises from anything beyond its control, including but not limited to the untimely performance by you of any of your obligations under this Agreement.

15. Maintenance
You acknowledge that interruptions to the With Love Fine Wedding Stationery website may be necessary from time to time in order to maintain the currency and performance of the website. With Love Fine Wedding Stationery shall not be liable for any loss or damage incurred by you due to such interruptions.

16. Cancellation and Refunds
We strongly advise that you choose your stationery carefully. As our stationery is made to order we cannot refund payment once work on the order has commenced. If for any reason the order is cancelled once it has commenced, any charges incurred will be at full cost to you.

17. Acceptance
Your autograph on the client order form is considered acknowledgement and acceptance of the above terms and conditions.

18. Amendments
This Agreement may only be varied by a document signed by or on behalf of each party.

19. Waiver
(a) Failure to exercise or enforce, or a delay in exercising or enforcing, or the partial exercise or enforcement of, a right, power or remedy provided by law or under this Agreement by a party does not preclude, or operate as a waiver of, the exercise or enforcement, or further exercise or enforcement, of that or any other right, power or remedy provided by law or under this Agreement.

(b) A waiver or consent given by a party under this Agreement is only effective and binding on that party if it is given or confirmed in writing by that party.

(c) No waiver of a breach of a term of this Agreement operates as a waiver of another breach of that term or of a breach of any other term of this Agreement.

20. Jurisdiction
(a) This Agreement is governed by and must be construed according to the law applying in Queensland.

(b) Each party irrevocably submits to the non exclusive jurisdiction of the courts of Queensland, and the courts competent to determine appeals from those courts, with respect to any proceedings that may be brought at any time relating to this Agreement;

Privacy Statement
Protecting your privacy is of the upmost importance to With Love Fine Wedding Stationery. By using this website or placing an order with us, you agree to the collection, use and storage of your information in the manner described in this Privacy Statement.

Where With Love Fine Wedding Stationery has access to personal information in order to fulfill its obligations under this Agreement, it shall:
(a) ensure that such personal information is protected against loss and against unauthorised access, use, modification or disclosure and against other misuse;

(b) not use the personal information other than for the purposes of the Agreement, unless required or authorised by law;

(c) not disclose the personal information without your written agreement;

(d) ensure that only authorised personnel of With Love Fine Wedding Stationery have access to the personal information;

(e) make its employees, agents and subcontractors aware of the With Love Fine Wedding Stationery’s obligations under this clause.

While With Love Fine Wedding Stationery strives to protect your personal information, With Love Fine Wedding Stationery cannot ensure the security of the information you transmit nor guarantee that any unauthorised access to your personally identifiable information will be prevented. With Love Fine Wedding Stationery urges you to take every precaution to protect your personal information while browsing the internet.

This website uses Google Analytics which records basic information about your usage, such as the type of operating system and browser you are using, the date, time and duration of your visit and the number of pages you viewed. When you browse this website, you do so anonymously - the information Google Analytics provides With Love Fine Wedding Stationery with does not identify you as an individual, it is simply information that is collected to provide With Love Fine Wedding Stationery with a better understanding of how you use this website.
